The Daisy Foundation Ltd Terms & Conditions
Each geographical area is owned and operated by an independent teacher under an exclusive membership agreement as granted by The Daisy Foundation who has been fully trained, assessed and granted the right to use The Daisy Foundation methods and marks by The Daisy Foundation. Each teacher will have completed a programme of study and examination and will have put in place insurances both in respect of Professional Indemnity and Public Liability.
COVID-19 Specific Terms & Conditions
It is our aim that our classes and workshops will return to and remain in the normal face to face format in a timely manner and when all government guidance deems it safe to do so. The safety of our clients and teachers is paramount, therefore classes and workshops will only proceed in person if all regulations can be safely adhered to. During the period of time in which the UK is in the staged lockdown easing process and any variety of COVID-19 response mechanisms that may develop as a result – The Daisy Foundation has implemented a set of COVID-19 Specific terms and conditions.
1. If your planned and booked (in-person) class cannot run as a result of Government or Local Authority guidance in the case of: local, regional or national lockdown, specific health guidance changes relating to pregnancy, postnatal or infants or any other Government/NHS recommendations – we refer to the force majeure clause and in this case no refunds will be given, however your teacher where possible may endeavour to offer an online alternative.
2. If your teacher must self-isolate but remains well enough to teach – planned face to face classes may be replaced by virtual classes (facilitated by zoom), returning to in-person delivery once the period of self-isolation has finished, or alternative sessions/credit to future sessions offered.
3. If your teacher is ill and unable to deliver planned sessions both in-person or virtually - either the offer of replacement sessions at the earliest possible date or credit for suitable future/alternative sessions will be offered.
4. If you (parent, carer or baby) are required to self-isolate credit for sessions missed during the period of self-isolation (maximum of 2 weeks) may at your teachers discretion be carried forward to a later date – this will be given in the form of a discount code to be used when making your next booking for any subsequent terms, classes or workshops. In this case no refunds will be offered.
5. If the planned venue is required to close as a result of any guidance, public health or any other reason at this time, your Daisy Teacher will attempt to secure an alternative local venue. If this cannot be done, classes may be offered virtually until a suitable alternative venue can be found, or credit for future/alternative sessions offered.
6. If you or your child develop symptoms of COVID-19 within 48 hours of attending a Daisy class or workshop or test positive for it – you are required to notify your Daisy Teacher without delay. If a teacher or another class participant notifies us of symptoms or a positive test in this way – you will be notified without delay. We will also notify the relevant NHS Test and Trace body relevant for England, Scotland, Northern Ireland or Wales. The Daisy Foundation is committed to following all UK Health and Safety government and NHS guidance related to COVID-19. In order to honour our increased hygiene, social distancing and venue requirements, we now have a COVID-19 Customer Charter.
COVID-19 Customer Charter
At Daisy we are excited to return to in-person classes. The health and safety of our clients and teachers is paramount. We aim to balance government guidance around the safe, welcoming and nurturing ethos of our classes.
To keep you safe, we pledge to do the following:
• Only to deliver in-person classes and workshops with approval of our safety measures by our local authority environmental health department, and to ensure any and all changes to local/regional guidance measures are acted upon as a matter of urgency.
• Only permit pre-booked clients to enter class to ensure we have the relevant contact details and updated medical questionnaire for all participants and can limit numbers to ensure social distancing measures can be honoured.
• Ensure all clients are spaced 2 metres apart.
• Space classes out to allow for adequate cleaning between groups.
• Clean all hard surfaces between classes.
• Sanitise all equipment between classes.
• Sanitise hands at the beginning and end of every class.
• Maintain 2 metres social distancing at all times.
• Ensure a regular cleaning regime for high traffic areas (door handles, bathrooms, hallways).
• Ask you to bring your own equipment for classes (mats/blanket etc).
• Offer you pre-sanitised baby toys for your own use in Daisy Baby Wrigglers and Cruisers classes.
• Ensure your ‘home-base’ socially distant area is clearly marked in all Daisy Baby classes.
• Provide hand sanitiser and ensure hand washing facilities are accessible from all classes.
• Teach in person only where teachers and their households are free of any symptoms of COVID-19.
• Follow guidance for ventilation within teaching environments, leaving windows open.
• Follow guidance where required for the wearing of face masks in common areas of venues and ensure all changes to guidelines are adhered to. We are adopting a ‘Wear your mask until you reach the mat’ approach in all classes.
• Make any appropriate amendments to class content so as to minimise risk, including but not limited to singing in baby classes.
In return we would ask that our clients help us to maintain this safe environment by following the guidelines below:
• Do not come to class if you (or your baby) has had any symptoms of Covid-19 (you must follow government guidance to self-isolate).
• Respect the guidance in relation to the wearing of face masks whenever and wherever they are required, or it is possible. We ask to you to adopt a ‘wear the mask until you reach the mat’ approach and respect the guidance for your UK region.
• If your baby has had a temperature within 48 hours of class, you should not attend classes.
• Sanitise your hands upon arrival and leaving class – there will be sanitiser available.
• Exercise patience upon arrival and departure to avoid congestion around doorways and common areas – respecting others and adhering to the 2 metres social distancing guidelines at all times.
• Arrive on time (and leave promptly) for your class to allow for the increased cleansing time between classes to take place.
• Bring any equipment to class that your teacher has suggested in your welcome email for your specific class – this may include yoga mat, cushion or your baby’s favourite instrument or rattle etc.
• Adopt the ‘catch it and bin it’ method for all coughs and sneezes – and ensuring all soiled tissues, nappies, wet-wipes or other waste is collected and disposed of at home.
• Understand that we may need to make small alterations to sections of class if we believe it to minimise the risk – this may impact singing in class, babies touching the book in wrigglers and cruisers etc.
By committing to this charter, and asking you to follow it too, we can relax and enjoy being back at in-person classes and enjoying the Daisy Magic as safely as we possibly can!
Booking & Renewal
Please be aware once you have booked and paid for your Daisy class, your local provider is under no obligation to provide refunds (see REFUNDS below).
Unlike some companies who operate an automatic rebooking process, to ensure you continue to enjoy your Daisy classes you will need to make a renewal payment with your local provider and it is recommended you do this no later than week 3 of your current course.
Changing Times and Venues
If your local provider needs to amend your class time or the venue at which your class is held they will endeavour to provide you with a minimum of 7 days notice. Where the start time is altered by less than 30 minutes and/or the venue is located within a 1 mile radius of original planned venue, no refunds will be offered.
Taking Payment
Please refer to your local provider for payment method. Payment is required in advance of your 1st class.
Refunds and Cancellations
Your local provider is under no obligation to refund or transfer your money in the event that you are unable to attend part of or the entire course. They are not obliged to guarantee an alternative class for missed lessons (unless this is due to them cancelling class).
In the event of a class or workshop being cancelled for any reason (other than in the case of a ‘force majeure’) by the teacher, the customer will be entitled to a refund on request.
In the unfortunate event you should suffer a miscarriage, please inform your local provider who will arrange a FULL refund.
If your pregnancy health care provider requests you cease attending classes due to medical reasons, you will be credited with sessions for use postnatally (within 6 months of baby being born if your teacher offers Daisy Baby classes, if they do not a refund for the missed classes will be given upon receipt of a doctors or midwives note.)
If your doctor or health visitor provider requests your baby or tot cease attending classes due to medical reasons, on production of a medical certificate you will be refunded the remaining classes of the term.
In the case of a ‘force majeure’ in this case defined as – Events beyond the reasonable control of your local Daisy Foundation Educator and The Daisy Foundation Ltd, including but not limited to: Extreme and unpredicted weather; Governmental regulation or advice relating to health or travel; Disease or Infection in the venue or local community. In any of these events or occurrences deemed as a ‘force majeure’ by reasonable interpretation the Daisy Foundation Ltd or your local Daisy Foundation educator is under no obligation to offer a refund.
Video & Photography
Pregnancy and Daisy Tinies classes: To respect the âÃÂÃÂopen and honestâÃÂànature of classes - no observers, family members, partners or friends are permitted into a Birthing class or a Tinies class in any circumstances other than student Daisy Birthing or Baby teachers, who may sometimes participate in class as a means of enhancing their training.
We have a no photography policy in any class to protect the privacy of the mums and babies unless you gain permission from your class teacher and have written consent from all of the mums and babies photographed in class. Such images are not to be shared via any public platform such as Facebook or other Internet sites unless you have written permission from your teacher and the mums which feature in the picture.
The Daisy Foundation forbid the right to film, reproduce or share any part of our lessons in any form (i.e. youtube, internet sites, DVDs, photography etc.) and anyone suspected of continually filming, observing or photographing the lessons for this purpose will be asked to leave the course.
All Daisy logos and material are copyright of The Daisy Foundation Ltd and Women's Wellbeing Ltd (which is a registered trade mark). The Daisy Foundation has granted your local provider the exclusive license to own and operate classes under this mark in their licensed area.
The Daisy Foundation Ltd and Women's Wellbeing Ltd cannot be held liable for the actions of third parties or for the actions of our self-employed local providers and therefore exclude, to the fullest extent possible by law, any liability arising from a breach of this section headed âÃÂÃÂVideo and PhotographyâÃÂàby any party.
Valuables and Jewellery
All property taken to class is left at your own risk. Neither The Daisy Foundation Ltd nor your local provider accepts responsibility for the loss or damage of any personal possessions before, during or after class.
Withdrawal of service
Your local Daisy provider may at their own discretion refuse entry to a client onto its courses.
Health and Safety
Whilst you are waiting for your class please keep noise to a minimum so that all lessons can take place in a calm atmosphere. Do not enter the studio whilst the current class is in progress; please wait to be invited in by your teacher.
Please be respectful of other mums in your class by ensuring that any personal belongings are neatly stored at the side of the room so that they are not a trip hazard and please make sure your mobile phone is on silent and stored away. Please ensure your local provider is aware of your contact number or emergency contact number changes. They can only notify you in the event of a cancelled class, if they have up-to-date contact information for you.
Cancelled Sessions âÃÂàIllness or Bad Weather
Your local provider will endeavour to ensure your scheduled class always runs. However, from time to time unforeseen circumstances will prevent this. They will ALWAYS attempt to make contact with you if class is cancelled, either via phone, text or email. Please ensure you always check your phone prior to leaving for class. If the weather is bad, please also check your local community group (this is often a closed facebook group and you will be invited to join in in your 1st booking welcome letter).
If your class teacher has deemed the weather fit to travel and has still run the class but you personally have decided not to attend then no refund will be given if the class was run.
Exclusion of Liability
In the absence of any proven negligence, lack of due diligence or breach of duty by the instructor, The Daisy Foundation, its licensees/local providers or employees, the participation of you, your partner, your baby or your child or those in whose care you have placed your baby/child for the purpose of attending class, is done so entirely at your and their own risk. The role of the Daisy Teacher is one of educator and no personal advice or recommendations will be given nor accepted.
Medical Conditions
It is vital that you inform your teacher of any medical conditions that you, your baby or tot may have which might affect their time in class. All information is treated sensitively and in confidence.
Such conditions may be (for Mother ) pre existing medical conditions or conditions which arise during pregnancy which include, but are not limited to: high blood pressure, low blood pressure, bleeding, spotting, history of miscarriage, placenta preavia, back or hip issues.
Such conditions (for Baby) may be pre existing medical conditions which include, but are not limited to: Hip Dysplasia, Hearing/Eye sight issues, Down Syndrome/Spina Bifida, Reflux, Colic, Torticollis.
It is your responsibility to keep them up to date with any conditions you may have and advise them of any new conditions or complications.
If you, your baby or tot is unwell or if you are unsure whether to attend a class or not you must inform your teacher BEFORE you come to class so that they can asses any risks to the other mums and babies in class and advise if you should attend or not. You may be asked to consult a GP before coming to class.
Never bring your baby or tot to class with an infectious disease such as conjunctivitis or chicken pox. In the instance of sickness and diarrhoea your child must be clear from all symptoms for at least 48 hours.
Nappies and Changing your Baby
Always change your baby on the floor using a suitable changing mat. Do not use raised surfaces (unless it is a purpose fitted baby changing table). Please take all nappies away with you unless a clearly marked bin has been provided. Never leave nappies in an open bin and never place these in a Sanitary Towel disposal unit.
Recommended Starting Age
For pregnancy, whilst some research shows exercise and movement can be beneficial in helping to prevent miscarriage, we suggest you wait until week 14 of your pregnancy before starting classes. If you choose to begin sessions sooner, this is a decision taken at your own risk.
We recommend you wait until 6 weeks postnatal before commencing our Daisy Baby or Daisy Mama programmes.
Reporting Complaints to your Instructor
Your local provider operates her own business under license as granted by The Daisy Foundation Ltd.
The Daisy Foundation Ltd operates the business and systems within the UK related to the copy right for all methods and marks (as owned by The Daisy Foundation and Women's Wellbeing Ltd and provide FEDANT approved training (in the case of Daisy Birthing). The Daisy Foundation Ltd assess quality prior to accrediting each instructor and carry out an annual checks to ensure each instructor operates with the correct insurances in place.
The Daisy Foundation Ltd cannot be held responsible for changes to local provisions, timetables, management of payments or the direct actions of your local teacher and provider.
